By using www.nityaonline.com (the “Website”) or placing an order you agree to these Terms.

2. Eligibility & account

3. Products & information

  • We sell ambient and other grocery products (the “Products”). We take reasonable care to ensure descriptions, images, ingredients, allergens, net quantity, storage, origin, and best‑before/use‑by information are accurate
  • Actual packaging/materials may vary from images. Always read labels and allergen warnings before use.
  • If you have a specific allergy, contact us before ordering

4. Prices & taxes

  • Prices are shown in GBP (£) and include VAT where applicable.
  • We may also display indicative EUR (€) prices for reference; GBP prices govern the contract.
  • We may change prices at any time before you place an order
  • Unit pricing (price per kg/L etc.) will be shown where required.
  • If we identify a pricing error after you order, we will contact you to cancel or reconfirm at the correct price. If you cancel, we will refund in full

5. Ordering & contract formation

  • When you place an order, you’ll receive an acknowledgement e‑mail. This is not acceptance.
  • A contract forms only when we e‑mail a dispatch confirmation (or when we deliver/you collect, if earlier).
  • We may decline/cancel an order if Products are unavailable, there is a pricing/stock error, we suspect fraud/abuse, or the delivery address is outside our service area.
  • Substitutions (groceries): If an item is unavailable, you may choose at checkout whether we can substitute similar items. You can refuse a substitution at delivery and we will refund that item.

6. Payment & security

  • Card payments are processed by our payment service provider using Strong Customer Authentication (SCA) where required. We do not store full card details.

7. Delivery & risk

  • We deliver within the UK mainland and selected postcodes [set out delivery exclusions/Highlands, Islands, Channel Islands, BFPO]. Delivery charges and available options (standard/express) are shown at checkout.
  • Timescales: Estimated dates are not guaranteed. We’re not liable for delays caused by events outside our control.
  • Passing of risk: Goods remain at our risk until they come into your or your named recipient’s physical possession. If you arrange your own courier (not offered by us), risk passes when we hand the goods to that courier.
  • Missed delivery: The courier will attempt redelivery/leave a card. Uncollected parcels may be returned; we may deduct any additional carrier charges actually incurred.

8. Your legal right to cancel (consumer distance sales)

  • For most items you have a legal 14‑day period to cancel from the day after delivery. To cancel, contact us at info@nityafoods.in or via your account.
  • You must return items within 14 days of telling us you’re cancelling. Keep proof of posting.
  • We will refund to your original payment method, including the least‑expensive standard delivery cost, within 14 days of receiving the goods (or of receiving proof of return)
  • You are responsible for any diminished value caused by unnecessary handling beyond what is needed to inspect the goods.
  • Exceptions: No cancellation right for:

(a)    goods liable to deteriorate or expire rapidly (many fresh/perishable foods);

(b)    sealed goods not suitable for return for health protection/hygiene reasons, once unsealed;

(c)    goods made to your specification or clearly personalized.

Important: Any store‑credit‑only policy does not affect your statutory right to a cash/ card refund where the law requires it.

9. Faulty, damaged or misdescribed items (statutory rights)

  • Your rights under the Consumer Rights Act 2015 apply:
    30‑day short‑term right to reject faulty items for a full refund;
    • otherwise, a right to repair or replacement, and if that’s impossible or fails, a price reduction or refund.
  • For damage/shortages, tell us within 48 hours of delivery with photos so we can investigate with the carrier.

10. Returns process

  • Start a return by contacting info@nityafoods.in quoting order number and reason.
  • We’ll provide a return address and instructions. For our error or faulty items, we’ll cover reasonable return costs or provide a prepaid label.
  • For change‑of‑mind returns, you bear return postage.

11. Promotions, vouchers & loyalty

  • Vouchers/coupons/points are non‑transferable, have no cash value, and are subject to their own terms (including expiry and minimum spend).
  • Unless stated otherwise, one promotional code per order.
  • If you cancel an order, we will restore any redeemed voucher where permitted by the voucher’s terms; if the voucher has expired by then, it may not be reissued.

12. Age‑restricted items

  • If we offer age‑restricted items (e.g., alcohol), delivery is subject to Challenge 25 verification. If you cannot prove age, we will refuse delivery and refund the item price (delivery/attempt fee may be retained where lawful).
  • We do not sell tobacco or vaping products.

13. Food safety & allergens

  • We follow UK food‑labelling rules. Allergen information is provided on product pages and/or packaging.
  • We handle a wide range of ingredients; cross‑contamination risks exist within supply chains. If in doubt, contact us before ordering.
  • Short‑dated/clearance items: Best‑before dates will be shown where relevant; such items are non‑returnable for date reasons when clearly disclosed at purchase.

14. Acceptable use of the Website

  • Do not misuse the Website (e.g., introduce malware, scrape without consent, bypass security, abuse reviews). We may suspend access to protect the service

15. Intellectual property

  • All content (including the Nitya and Vexfo names, logos, images, product data, and site design) is owned by or licensed to us. No license is granted except to use the site for personal, non‑commercial shopping.

16. Liability

  • We do not exclude liability where unlawful to do so, including for death or personal injury caused by negligence, fraud, or your statutory rights.
  • We are not liable for indirect losses (e.g., loss of profit, business interruption) and, for other losses, our liability is capped at the price paid for the affected order.

17. Complaints & ADR

  • We aim to resolve complaints internally. Contact info@vexfo.co.uk.
  • If we cannot resolve a complaint, information about suitable Alternative Dispute Resolution (ADR) providers will be made available. We are [willing/not willing] to submit to ADR. This does not affect your right to go to court.

19. Events outside our control (force majeure)

  • We are not responsible for failure or delay where caused by events beyond our reasonable control. We will contact you and take reasonable steps to minimize the effect

20. Other important terms

  • Assignment: We may transfer our rights/obligations to another organization; your rights will not be affected.
  • Severance: If a court finds part of these Terms unlawful, the rest continues in force.
  • No waiver: Delay in enforcing these Terms does not waive our rights
  • Entire agreement: These Terms and any referenced policies form the entire agreement for your order.

21. Governing law & jurisdiction

  • These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction.
